Terms of Service
§ I Preamble
- This document specifies the terms and conditions for access to and use of the SaaS application (hereinafter referred to as the “Application”), provided by MANIS Paweł Koteluk, with its registered office at ul. Os. Piastów Śl. 9/11, 47-100 Strzelce Opolskie, NIP (Tax Identification Number): 7561902608, contact: [email protected].
- Every User, upon commencing actions aimed at using the Application, is obliged to read, comply with, and accept these Terms and Conditions without limitation or reservation.
- In the event of disagreement with all Terms and Conditions, the User is obliged to cease using the Application and leave it immediately.
- All trade names, company names, and their logos used in the Application belong to their respective owners and are used for identification purposes only. They may be protected by trademarks.
- Unauthorized use of the Application's content, works, or information, as well as their unauthorized reproduction, retransmission, or other use of any element of the Application, is prohibited, as such actions may infringe, among other things, copyrights or protected trademarks.

§ II Definitions
- Applicable Law – For the purposes of implementing these Terms and Conditions, Polish law shall apply.
- Application – A SaaS tool named trimida.com, used for creating and managing offers, orders, payments, and communication with clients.
- User – A natural person, legal entity, or organizational unit without legal personality that has created an account in the Application and uses its functionalities.
- Account – An individual User account in the Application, enabling access to services.
- Offer – A proposal directed to clients, containing a description, terms, and other details, created by the User in the Application.
- Subscription – A periodic fee for using the Application, depending on the chosen plan (Free, Basic, Enterprise).
§ III Scope of Conditions
- The Owner provides access to the Application in accordance with these Terms and Conditions.
- The content and data published in the Application are for informational purposes and may only be used for purposes consistent with its intended use.
- Users may use the Application provided they have previously agreed to these Terms and Conditions.
§ IV Conditions of Use of the Application
- Registration and Account
- To use the Application, the User must create an account by providing the required data (name, surname, email address, VAT invoice details).
- The User undertakes not to share their login details with third parties.
- Subscription Plans
The User can choose one of the available subscription plans:
- Free – a free plan with limited features (1 offer, 2 GDPR consents, 1 user, 1 organization).
- Basic – a paid plan (PLN 129 per month or PLN 1290 per year) with extended features (7 offers, 5 GDPR consents, 1 user, 2 organizations).
- Enterprise – the scope of functionalities is determined individually.
- Account Suspension or Deletion
- The Service Provider reserves the right to suspend or delete the User's account in the event of a breach of these Terms and Conditions.
- The User may delete their account at any time, thereby resigning from the use of the Application.
§ V Payments and Subscriptions
- Fees for Services
- Services under the Basic and Enterprise plans are paid.
- Payments can be made via subscription (automatic renewal) or a VAT invoice issued at the beginning of each month.
- In the case of an Enterprise account, the Service Provider reserves the right to change prices if the User exceeds the initially set data limits (e.g., number of offers, GDPR consents, users, or organizations).
- The Service Provider will inform the User of any price changes one month in advance by sending a notification to the email address associated with the account.
- New prices are effective from the first day of the next billing period after one month from the date of notification.
- Refunds
- In the event of subscription cancellation, the User may receive a refund for the unused period.
- Subscription Price Changes
- The Service Provider reserves the right to change subscription prices after prior notification to the User.
§ VI Cookies
- The Application uses cookies to ensure proper operation, analyze traffic, and personalize content.
- The User can manage cookie settings in their browser.
- Limiting or blocking cookies may affect some functions of the Application and hinder full use of its capabilities.
§ VII Personal Data Protection
- The Owner collects and processes Users' personal data in accordance with applicable GDPR regulations.
- The data collected by the Application includes: name, surname, VAT invoice details, and data entered by the User when creating offers and records.
- The data is processed for the purpose of providing services and fulfilling the contract.
- The User has the right to access their data, correct it, delete it, and object to its processing.
- Detailed information on the processing of personal data, including the purposes and legal basis, can be found in the Privacy Policy .
§ VIII Copyright and Intellectual Property
- All copyrights and other intellectual property rights related to the Application belong to the Owner.
- The User has no right to copy, modify, distribute, or use the Application in a way that infringes the Owner's rights.
- Without the Owner's written consent, it is forbidden to reproduce the Application's source code, decompile it, and attempt to bypass security measures.
§ IX Limitation of Liability
- The Owner is not liable for the User's use of the Application or for damages resulting from the User's actions.
- The Owner is not responsible for any losses resulting from the improper functioning of the Application, unless they are caused by the Owner's intentional actions or gross negligence.
- The Owner is not liable for failures of external systems (e.g., servers, payment providers) that may affect the operation of the Application.
§ X Changes to Terms
- The Owner reserves the right to change these Terms and Conditions at any time.
- Users will be notified of changes electronically at least 14 days before they come into effect.
- If the User does not accept the new Terms and Conditions, they may stop using the Application before the date they come into effect.
- Continued use of the Application after the changes to the Terms and Conditions constitutes acceptance thereof.
§ XI Termination of Agreement
- The User may terminate the service at any time by deleting their account in the Application.
- In the event of subscription cancellation, the User will not incur any penalties, however, fees for the already paid subscription period are not refundable, unless otherwise provided by law.
- Account deletion does not affect obligations incurred before its deletion, including any payments or obligations arising from the regulations.
§ XII Dispute Resolution
- Any disputes arising from the use of the Application will be resolved by the court having jurisdiction over the Owner's registered office, unless mandatory provisions of law stipulate otherwise.
- The Owner allows for the possibility of resolving disputes through mediation or arbitration if both parties agree.
§ XIII Final Provisions
- These Terms and Conditions constitute the complete agreement between the User and the Owner.
- In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply.
- If any provision of these Terms and Conditions is found to be invalid or ineffective, it shall not affect the validity of the remaining provisions.
- Issues related to the processing of personal data are described in the Privacy Policy , which the User should read.
These Terms and Conditions are effective from February 1, 2025 and remain in force until amended or revoked by the Owner.
